This is especially so where the parties involved do not want to engage expensive lawyers. If both parties have the wisdom not to battle it out in court, mediation is the way to go. 

 

Mediation allows parties who are in, or who are contemplating, litigation or arbitration, to put disputes behind them and avoid the personal and commercial effects of being engaged in costly and lengthy disputes. Parties also find mediation attractive because of its high success rate and because it allows parties to ‘think outside the box’.  If therefore the parties want an ongoing relationship, the ability to craft a remedy in mediation is often preferable to the blunt instrument of litigation or arbitration.

It is advantageous if both parties recognise the benefits of early settlement. If you can ever do that, it’s in your best interest to at least take a shot at it. Typically, it’s worth the money you pay, because if you can get it settled, you’re saving yourself not just a lot of money at the very end of a case, you’re saving yourself a good deal of money for the whole case.
